The Member of Parliament (MP) Asante Akyem North Constituency Lawyer Andy Appiah-Kubi,, will on Wednesday , September 28, 2020, face committal proceedings for contempt of court at an Accra High Court.
The proceedings are for carrying himself about as New Patriotic Party’s Parliamentary Candidate Asante Akyem North Constituency and branding cars and making billboards and posters as elected candidate.
In the motion on notice for the contempt proceedings sighted by the Adanse3 fm, the lawyer for the 145 Polling Station Executives whose names have been allegedly expunged from the delegates’ album of the NPP in the Asante Akyem North Constituency, Samson Lardy, in an affidavit in support, prayed the court for an order to commit Andy Appiah-Kubi into prison custody for disobeying its lawful requests.
The agenda for today's court hearing was that a motion to dismiss the suit was to be argued. The court started by asking Nana Obiri Boahen why the defendants have decided to bring a motion that was dismissed.
Two weeks ago, the same motions by the defendants were dismissed by the court. The judge cautioned the two to stop their delay tactics.
Obiri Boahen said as an astute lawyer and official of the party, he was interested in an amicable resolution of the suit by the about 140 delegates challenging the removal of their names from the constituency album or register.
He pleaded with the court for the case to adjourn to next week Wednesday to give the opportunity to verify a claim by Andy that he is the party's candidate.
He said the claim in an affidavit by Andy was only given to him this morning in court.
Lawyer for the aggrieved delegates, Samson Lardy told the court that they have submitted evidence including Primaries Elections Report in which the party says no elections have taken place in Asante Akim North.
He said the evidence also includes official announcements by the NPP ahead of the primaries in June that there will not elections in the constituency because of an injunction.
He also mentioned that the national party and EC refused to supervise any primaries there because they were served with the pending injunction. He mentioned to the court that EC has opened nominations so the case can be heard quickly.
The judge reacted to that by saying that it what the court will rule in the end that will hold and not what the EC will do.
Lawyer for the Plaintiffs also stated that the earlier the injunction or case is determined the better because as things stand now, the EC which refused to supervise the primaries will not accept any nomination form from Andy.
Obiri Boahen pleaded for the case to be adjourned, Andy wanted a longer adjournment but the court refused and adjourned to Wednesday when he said he will give his decision because he all the documents filed to do so.
Justice Stephen Oppong of GJ3 also urged the parties to try the suggestion by Obiri Boahen to settle the case as a family issue. Meanwhile, the Plaintiffs have filed for contempt asking the court the put Andy into prison or appropriate punishment for carrying himself about as PC and branding cars and making billboards and posters.
The matter has been adjourned to September 23, 2020.
It would be recalled that about 145 delegates in 61 polling stations, mostly from Agogo whose names have been unlawfully and fraudulently deleted from the original photo album of the NPP in the Asante Akyem North Constituency successfully filed a suit and an injunction against the party, the Electoral commission and Andy Appiah Kubi on 18th June, 2020.
